¿Cuántos días de vacaciones por ley corresponden?
El Estatuto de los Trabajadores establece un periodo mínimo de vacaciones de 30 días naturales; no obstante, por convenio colectivo pueden reconocerse más días. Este periodo de vacaciones es para un año de trabajo completo, por tanto, si un trabajador no ha trabajado durante todo el año, por haber comenzado la relación laboral una vez iniciado este, o por haber finalizado su relación laboral antes de su finalización, sólo tendrá derecho a la parte proporcional de las vacaciones correspondientes al periodo trabajado.
¿Quién elige los días de vacaciones por ley a disfrutar?
Existe una falsa creencia según la cual la empresa fija la mitad del periodo de vacaciones y el trabajador la otra mitad. El periodo de vacaciones debe fijarse de común acuerdo entre la empresa y el trabajador, de acuerdo con lo establecido, en su caso, en el convenio colectivo de aplicación. En caso de no existir acuerdo para la fijación del periodo de vacaciones, podría, por parte del trabajador, iniciarse un procedimiento judicial para que sea el Juzgado de lo Social quién fije las fechas del disfrute de las vacaciones.
¿Con qué antelación deben fijarse las fechas de vacaciones?
El trabajador tiene derecho a conocer la fecha de disfrute de las vacaciones con, al menos, dos meses de antelación. Si existe convenio colectivo, éste podría establecer un periodo de antelación superior.
Un trabajador que está de vacaciones, ¿puede ser despedido?
Se puede despedir a un trabajador que está de vacaciones, si bien la comunicación del despido al trabajador debe realizarse por escrito.
¿Pueden sustituirse las vacaciones por compensación económica?
El disfrute de las vacaciones es obligatorio, por tanto, no se pueden pagar. La única excepción a esta regla es la extinción del contrato, en cuyo caso se pueden pagar los días devengados y no disfrutados.
